These Terms & Conditions outline the expectations, responsibilities, and standard practices that apply when engaging Zagari Concrete for commercial concreting services. By accepting a quote or proceeding with our works, you acknowledge and agree to the following terms. We’ve kept it clear and practical, just like the way we work.
1. Definitions
“Zagari Concrete”, “we”, “our” or “us” refers to Zagari Concrete Pty Ltd.
“Client” or “you” refers to the party engaging our services.
“Works” refers to the concreting services and related activities provided by Zagari Concrete.
2. Quotations & Acceptance
All quotes are valid for 30 days unless otherwise stated.
Acceptance of a quote constitutes agreement to these terms and conditions.
Variations requested after quote acceptance may incur additional charges.
3. Scope of Work
Works will be carried out as detailed in the accepted quote or scope of works.
Any changes to the scope must be agreed upon in writing.
Zagari Concrete reserves the right to refuse changes that impact quality, safety, or compliance.
4. Access & Site Requirements
The client must ensure clear and safe access to the site for all personnel, vehicles, and equipment.
Any delays caused by restricted access, site readiness, or other contractor interference may result in additional charges.
The client is responsible for providing accurate site levels and boundaries unless specified otherwise.
5. Substrate & Ground Conditions
Zagari Concrete is not liable for unforeseen conditions beneath the surface (e.g., rock, debris, services) unless disclosed in advance.
Additional preparation or excavation required due to ground conditions will be treated as a variation.
6. Weather & Unforeseen Delays
Works may be rescheduled due to unsafe weather conditions or other unforeseen circumstances.
Zagari Concrete is not liable for delays outside of our control but will communicate any changes promptly.
7. Materials & Finish
We work with trusted suppliers and ensure materials meet project specifications.
Exposed aggregate and coloured concrete are subject to natural variation in colour, texture, and finish. These are not considered defects.
Sealer application is weather dependent and may occur after initial pour.
8. Payments
Payment terms will be outlined in the project quote or agreement.
A deposit may be required prior to works commencing.
Progress payments may be requested for staged works or extended timelines.
Full payment is required upon completion unless otherwise agreed.
Late payments may attract fees or interest in line with applicable laws.
9. Defects & Liability
The client must notify Zagari Concrete of any concerns or defects within 7 days of completion.
We will address any verified workmanship issues promptly and fairly.
Zagari Concrete is not liable for cracking, discolouration, or surface wear resulting from misuse, poor maintenance, or site conditions outside our control.
10. Cancellations
Cancellations made after acceptance may incur costs for labour, materials, or preparation already undertaken.
Notice must be provided in writing.
11. Insurance & Compliance
Zagari Concrete maintains appropriate public liability, workers compensation, and construction insurance.
All works are completed in line with relevant South Australian regulations, industry standards, and WHS practices.
12. Intellectual Property
Any documentation, designs, or plans provided by Zagari Concrete remain our intellectual property unless otherwise agreed.
13. Privacy
We collect and store client information solely for the purpose of managing projects, communications, and billing.
Your information will not be shared with third parties except where required for delivery of services or by law.

14. Governing Law
These terms are governed by the laws of South Australia. Any disputes arising will be handled within South Australian jurisdiction.
